CITY OF SOUTHSIDE
COUNTY OF ETOWAH
STATE OF ALABAMA

AN ORDINANCE TO AMEND ORDINANCE NUMBER 0-006-2005, THE ZONING MAP OF
THE CITY OF SOUTHSIDE, ALABAMA. TO ANNEX AND REZONE 12.5 ACRES OF LAND
IN LAKE FOREST SUBDIVISION. PARCEL 12-03-07-0-001-014.002 DISTRICT 25.

TO ANNEX SAID PROPERTY, AND REZONE FROM
AGRICULTURAL (AG) TO SINGLE FAMILY RESIDENTIAL (R-1)

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHSIDE, ALABAMA, AS
FOLLOWS:
TO ANNEX INTO THE CITY OF SOUTHSIDE AND REZONE 12.5 ACRES OF LAND IN
LAKE FOREST SUBDIVISION. PARCEL 12-03-07-0-001-014.002 DISTRICT 25 REZONING
FROM AGRICULTURAL (AG) TO SINGLE FAMILY RESIDENTIAL (R-1).

SECTION 1. That the Zoning Map of the City of Southside, Alabama be hereby amended to reflect the
following change of zoning in the City of Southside, Alabama.

SECTION 2. That the described property be annexed into the city limits of the City of Southside,
Alabama, and is now zoned AG -Agricultural.
SECTION 3. That this same portion of the above, described property or territory be and the same is
hereby annexed into the City of Southside, and rezoned to R-1 Single Family Residential as the same is
defined in said Zoning Ordinance 0-231-04, City of Southside, Alabama, for the purpose of enabling
said real estate to be devoted to such use as permitted under said Zoning Ordinance No.0-231-04 Single
Family Residential.
Legal Description: Parcel 12-03-07-0-001-014.002 Owner being Smokeneck Holdings, LLC.

LEGAL DESCRIPTION
A PARCEL OF LAND SITUATED IN Section 7, Township 13 South, Range 6 East, Etowah County, Alabama, being more
particularly described as follows:
Commence at rebar capped Dowdy at the SE corner Lot 1 of Lake Forest Subdivision as recorded in Plat Book K Page
115 in the Office of the Judge of Probate in Etowah County, Alabama said point also being a point on the Northwest right of
way of Lake Forest Dr; thence S 37*3040 W along the Southeast line of said Lot 1 and said right of way a distance of
128.76 feet to a rebar capped Dowdy at the SW corner of said Lot 1; thence S 30*2351 W leaving said Lot 1 and along
said right of way a distance of 245.09 feet to a point; thence S 28*3343 E along the Southwest right of way of Lake Forest

Drive a distance of 70.59 feet to the intersection of the northwest line of a proposed right of way and said right of way of
Lake Forest Drive; thence S 61*1523 W leaving Lake Forest Drive right of way and along the northwest lien of proposed
right of way a distance of 343.71 feet to a point of curve to the left having a central angle of 29*4348 and a radius of
225.00 feet, said curve subtended by a chord bearing S 46*2329 W and a chord distance of 115.44 feet;
thence along the arc of said curve and along said proposed right of way a distance of 116.75 feet to a mag nail at the POINT
OF BEGINNING, said point being a point of compound curve having a central angle of 29*5346 and a radius of 225.00
feet, said curve subtended by a chord bearing S 16*3442 W and a chord distance of 116.07 feet; thence along the arc of said
curve along the westerly line of said proposed right of way a distance of 117.40 feet to a rebar capped EDG; thence S
01*3749 W along said proposed right of way a distance of 55.97 feet to a rebar capped EDG at the point of curve to the
right having a central angle of 53*5805 and a radius of 25.00 feet, said curve subtended by a chord bearing S 28*3652 W
and a chord distance of 22.69 feet; thence along the arc of said curve and along said proposed right of way a distance of 23.55
feet to a 1/2 rebar capped EDG; thence N 87*4344 W leaving said right of way a distance of 396.11 feet to a rebar capped
EDG on the 509 contour line; thence northeasterly along the 509 contour for a distance of 243 feet more or less to a point,
having a cord bearing of N 42*0317 E a chord distance of 237.67 feet; thence S 88*5823 E leaving said 509 contour a
distance of 282.22 feet to the POINT OF BEGINNING. Said parcel of land contains 1.48 acres, more or less.
SECTION 4. The sections, paragraphs, sentences, clauses and phrases of this ordinance are severable,
and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by a court of competent jurisdiction, then such ruling shall not affect any other
paragraphs and sections, since the same would have been enacted by the city council without the
incorporation of any such unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 5. This Ordinance shall become effective after such posting of said ordinance as required
by law.
